Under The Framework Of WTO Biofuel Subsidies Legal Problem Research

The expansion of the global economic has damaged the global energy, environment and so on. The safety and independence of the energy is the guarantee of the development of economic, the diversified energy structure is the main target of the energy strategy. According to the advance in energy, economic, society and environment of the biofuels, biofuels becomes the one of the diversified energy structure, the countries in the world begin to make policies to promote the development of the biofuels, especially the development in the USA, Brazil and the EU, in which countries the subsidies policies has the respective significant. But the development of the biofuel is not as originally envisaged with full benefits. In fact it is a threat to the safety of the food and the environment at the same time. It has an affection on the price of the crop and injury the environment. The core problem of the biofuels is the subisidies. To promote the development of the biofuel, the countries made all kinds of the policies of support. These policies also contributed to a certain extent, the impact of biofuel on the direction and scales of world trade. How to balance the compatibility between the WTO and the biofuels subsidies legal system is the core and focus of the biofuels subsidies problem currently.This paper hopes that it can base on the analysis the compatibility between the WTO and the biofuels subsidies legal system, to put forward the legislative proposal in our country. First, the paper analysises the situation of the biofuels to draw forth the subsidies problem. Second, it based on the discussion of the biofuels subsidies system in the nations of the world which are major producers and biofuels production chain as the main line, to analysis the subsidies system. Third, it analysis the relationship between the biofuels subsidies system and the WTO relevant laws, especially the he Agreement on Subsidies and Countervailing Measures and the Agreement on Agricultural. At last, based on the analyzing of the advantage and disadvantage of the biofuels industry in our country, the paper proposes the road map of the biofuels subsidies systerm in our country which is fit the national conditions. The paper proposes our country should base on the biofuels production chain and the different subsidy subject of the different production stage, use the different subsidy methods, to build the biofuels subsidies legal system which suit our country basic situation, so that we can promote the development of the bifouels in the legal level.
