Problems In The Legal System Of Agricultural Subsidies In China And The Counter Measures

In the national law and policy system to support agriculture usually agricultural subsidies as an important policy tool,agricultural subsidies can not only guarantee the income of farmers,and the prices of agricultural products keep in a reasonable range has important significance.At present,China’s agricultural development entered during the transition period of industry nurturing agriculture and the Doha Round negotiations on agriculture also made some achievements,China about agricultural subsidy system reform should be optimized.First of all,the article explains the general situation of agricultural subsidy and its system.The paper points out that agricultural subsidies is the government in order to achieve food security,increase farmer income level and the sustainable development of agriculture policy objectives of agricultural production,circulation,trade activities or agricultural producers to provide with function oriented transfer of fiscal expenditure.And agricultural subsidy system in all countries in order to achieve the goal of protecting agricultural development,to agricultural production,agricultural products circulation of agricultural products and trade links of transfer payment specification in general,it contains a country and agricultural subsidies related laws,regulations,rules and the concluded or joined the international treaty,agreement.On this basis,the classification of agricultural subsidies carried out and and put forward China agricultural subsidies of the theoretical basis and practical needs,this paper argues that the agricultural externality,public products attribute and function of China for agricultural subsidy provides a theoretical basis,and under the framework of WTO agricultural subsidies in the WTO commitments and the particularity of agricultural development at the present stage for China’s agricultural subsidies provide the practical needs.Secondly,the article analyzes the status quo of China’s agricultural subsidy system and the existing problems and causes of the analysis.The paper points out that the Chinese agriculture subsidy system has experienced different stages of development with the industrialization process of China,from the agricultural support industry to industry nurturing agriculture,the Chinese agriculture subsidy system reform of the deep water area of the.However,the system of agricultural subsidies in China at the present stage,there are still many problems,agricultural subsidy system is not perfect,agricultural subsidies target positioning is not clear,management system of agricultural subsidies is not smooth,agricultural subsidies unreasonable problems exist in large numbers.The paper believes that the formation of the above problems is closely related to the constraints of China’s agricultural WTO commitments,the lack of China’s current agricultural legislation,economic factors and so on.Thirdly,In this article,we investigation in some foreign developed and developing countries agricultural subsidy system practice and the Bali after the period of agricultural subsidies under WTO system new development trend,analysis of China’s experience of foreign agricultural subsidy is a useful reference,discussing the Bali period Chinese agricultural subsidies to.In this paper,the United States,Europe,Japan and other developed countries on agricultural subsidy legislation,the structure,the way I state-owned strong reference,and major developing countries agricultural subsidy practice of the system of agriculture subsidy of our country the adjustment have strong implications of.At the same time,the WTO agricultural subsidy system in Bali also provides an opportunity for the improvement of China’s agricultural subsidy system.Finally,the article combined with the current situation of China’s agricultural development,to explore and improve the system of agricultural subsidies.The,China should be the goal of accurate positioning of agricultural subsidies,optimization of agricultural subsidies,in principle,construct perfect legal system of agricultural subsidies,on this basis.At the same time,straighten out the agricultural subsidy management system,to adjust the current subsidy structure and it is urgent to take countermeasures.
