In recent years, many colleges and universities in China, a lot of disabled people aresuffering various degrees of damage in the process of admission and education in many Chinesecolleges and universities. Therefore, we urgently need a series of laws to protect the rights ofhigher education of disabled people. The similarity between the United States and China is theimportant proportion of disabled people. The difference is that the United States haspromulgated a series of laws and regulations to protect the rights of higher education ofdisabled people, and the maintenances of the rights has gained international recognition. TheUnited States is a federal state, and has a complete higher education system of rights fordisabled people. This paper study about the legal protection of the rights of higher education ofdisabled people in America, and summarizes the enlightenments, hope to help the developmentof education of disabled people in China.The research methods of this paper are literature research, comparative study and caseanalysis. The text is divided into six parts.Chapter Ⅰ: Introduction. Introduction mainly discusses the origin and significance of thetopics, research status, the core definition, research ideas and research methods.Chapter Ⅱ: Important Acts of American Higher Education Rights of Disabled People.Based on the federal law, there are three influential acts, Americans With Disabilities Act,Rehabilitation Act, and Individuals with Disabilities Education Act, have been discussed.Chapter Ⅲ: The Implementation of the Acts of American Higher Education Rights ofDisabled People. Acts enacted by legislative institution need execute by the enforcementprocedures, this chapter mainly discusses who execute these acts. There are four institutions toguarantee these acts execute effectively: the court, human rights institutions, andnon-governmental organizations.Chapter Ⅳ: Higher Education for the Disabled Rights Legal Remedy. Means how or inwhat way to protect the rights of higher education of disabled people in America. Mainlydiscusses appeal system, mediation system, legal system, and other way for relief.Chapter Ⅴ: The Advantages and Problems of the Legal Protection of the Rights of HigherEducation of Disabled People in America. This chapter mainly discusses three advantages andthree problems. The advantages are the diversity of the legal system, the separation of powersof the legislative mechanisms, and the practicability of the law. The problems are long follow-up legislation process, the powerful influences of political factors, the existence of legalabuse.Chapter Ⅵ: The Status of the Legal Protection of the Rights of Higher Education ofDisabled People in China and the enlightenments of American experiences. In the part of theenlightenment, summarized four American experiences. These are the cultivation anddevelopment of law on higher education for disabled people, specialization andprofessionalization of the legislative body of higher education for disabled people, normativeand progressive legislative procedure of higher education for disabled people, the operabilityand variability of law on higher education for disabled people.
