Education has been an essential issue in recent years,every country in the world is trying to improve the whole nation's qualities and enhance comprehensive national strength through education.However,to the disabled people that have been increasing rapidly in recent years,their rights of being educated will be violated.From basic education to secondary education and higher education,even vocational education,disabled students can not complete their school work successfully.Discrimination and unfair treatment happens all the time,the disabled children are “labeled” inequality even when they are fewer than six.But as the countries pay attention to education increasingly,more and more educators come to realize that not only should normal students accept well education,but also disabled students should be concerned.So the laws concerning the disabled students' rights have been came out,the laws and related rules are approached perfection,while Chinese related laws need to be enhanced in content and force.This paper refers to make a reference through the research on the legal protection of rights and interests of students with disabilities in higher education in America.This paper is based on historical process,analyzing the background,status quo and content of the topic.Meanwhile,the paper uses historical approach,literature research method and case analysis method.The paper includes four parts:the first part describes higher education of disabled students,including the origin of disabled students' education,the development of history before 1970 s and the currency.The second part analyses laws of education basis on higher education of disabled students from 1970 s to 1990 s,except for the content and characteristics of the laws,background of this period is also inferred.The third part analyses education of disabled students of American universities,including the rules of entrance,buildings of universities,facilities of education and vocations about several well-known universities.The last part analyses the situation of China and the advantages and disadvantages of America.The creativity of this essay is mainly pay attention to the higher education of American disabilities,comparing with other essays which mainly talk about basic education and secondary education.However,there are also defects on the description of related laws.
