Discussions on "college crisis" or "education crisis" have been worldwide launched.Since1960s and gradually some critical force has been formed both in western anddeveloping countries. The close attention of the mass media to various academic scandals,researches and hiring frauds obviously shows public’s press strong dissatisfaction tocurrent higher education.Analyzed the internal organizations of universities or colleges, thedislocation and weakness of academic power directly caused modern university crisis. Dueto the particularity of university power and the special status of academic power which isdifferent from other common political power, the essence of academic power actually is theprocessional competence and academic ability. Thus, as the actual undertaker of scienceresearch and teaching tasks in public colleges and universities, teachers should havebecome the main part of academic power. However, the fact is not as optimistic asexpected. Those related problems may occur at any point of this procedure that includesteacher employment, teaching activities, professional title evaluation, promotion andresignation or dismissal. In recent years, such legal cases often happen and cause reactions.Therefore, we have to make further thoughts on how to re-establish more appropriatemanagement system of universities. Most of researches on academic power just onlyremain at the stage of appealing to the executive power’s compromise and also made noclear definition of academic power’s domination part. Based on the study of academicpower and its legitimacy with the analysis of related cases, this paper puts forward the ideathat academic power needs law restraints and further research on related substantive andprocedural law seperatly.The author expects more attention from academic circles will bepaid to the higher education field and especially university teachers will have better legalprotection on academic rights. Meanwhile universities and colleges will have no more"exterritoriality" to infringe the interests of teachers and higher education won’t have toface a lawless situation.
