As the process of global economic integration accelerates and knowledge-basedeconomy tends to be dominant, IPR (Intellectual Property Rights) has become the keyto the cultivation of the country’s core competitiveness and national economicdevelopment. Nowadays the protection of IPR plays an increasingly important role.Customs protection of IPR, which is an important part of the protection of IPR, inaccordance with authority of related state laws, is an enforcement measure customsshall take in the import and export aspects to stop the goods infringing IPR protectedby the national laws and regulations entering or leaving the territory. Theimplementation of China customs protection of IPR is of great significance tostrengthen the international competitiveness of Chinese enterprises, to improve thedomestic economic situation, to achieve an orderly international trading environmentand to safeguard the interests of IPR holders. Since “Regulations of the People’sRepublic of China on Customs Protection of IPR” was promulgated and implementedin1995, China has gradually established a system of customs protection of IPR thatsuits its reality. In recent years, the achievements of China customs protection of IPRhave been paid high attention to and given a good evaluation by the internationalcommunity. But with the economic and social development, there is room forimprovement in the system.This thesis use several research methods, such as inductive reasoning,comparative analysis, empirical analysis, etc. Firstly, it objectively analyzes thecurrent situation and problems of customs protection of IPR in our country. Secondly,it studies advanced laws and practices of customs protection of IPR in Japan and theNetherlands, to provide a reference for China Customs. Thirdly, take example forimport and export enterprises in Suzhou Customs territory, it analyzes the problems ofdomestic enterprises in border protection of IPR. Finally, it offers some suggestionson improving China customs protection of IPR.
