The Study On Intellectual Property Rights Protection And Countermeasure In Hunan Province

With the integration development of world economic and the fusion of technological economy,the world has realized the great value of intellectual property to a country or region.The developed countries such as the United states,Japan and Korea have rised the development of intellectual property to a national strategic level.As the main public organization of social utility management,the governmental or non-governmental organizations must take the responsibility to guide the scientific and rational use of intellectual property rights,which has become the consensus of the future development of modern countries.In the context of global economic integration and intellectual property rights increasingly becoming the focus of international trade disputes,it is the only way that implementing the strategy of intellectual property,strengthening the protection of intellectual property rights,and increasing the ability of independent innovation to enhance China's comprehensive strength and international competitiveness.In recent years,the Hunan provincial Party committee and the provincial government have put forward the major strategy of "strengthening the province by science and education" and "IP-driven province".and issued some outline documents such as “the Implementation Outline of Intellectual Property Strategy of Hunan Province”,“the Intellectual Property Talent Development Plan of Hunan Province”,“the Patent Regulations of Hunan Province”,and “Opinions on accelerate the construction of IP-driven province”,which strongly improved the status of intellectual property protection.Nevertheless,there are some problems in the protection of intellectual property of Hunan Province,such as the inefficiency of intellectual property protection,the weak protection ability of innovation and market subject,the urgency of improving the intermediary services of intellectual property and the low level internationalization of intellectual property protection,etc.From the perspective of government and society,this article analyses the deep-seated reasons that leading to these problems such as the lack of strategic planning of intellectual property protection,the imperfect system of intellectual property protection,the lack of independent innovation ability of enterprises,and the lack of capacity of social organizations to protect intellectual property rights.In addition,from the backgroundof the development of globalization,this article reveals the status quo that the protection of intellectual property can not meet the needs of the globalization development.This article puts forward some improving measures to strengthen the macro planning and management of intellectual property protection,to promote the protection system of intellectual property rights,to enhance the protection level of intellectual property rights of market players,and to develop the social organization of intellectual property rights.
