Over the years, the problem that serious colliery accidents occur frequently has not been fundamentally resolved. The government, as the regulatory policy-maker and implemented has been persisting in improving the regulatory system and strengthening regulatory enforcement. Simultaneously, domestic and overseas scholars have been conducting more and more in-depth studies of colliery safety regulation. Political and academic circles are all attempting to study the crux of the problem in order to curb colliery accidents thoroughly. However, the majority of the government, the society or senior scholars, owe the cause of colliery accidents to the existing unsound regulatory system and inadequate safety regulation. Rarely have they been aware of the fluctuation collectively caused by deregulation and excessive regulation. As a matter of fact, safety regulation fluctuation which is potential and hard to discover constitutes a principal factor of colliery safety. The most widely applied measure when a colliery accident occurs is to suspend production for rectification under the circumstances of administrative accountability and public opinion for the purpose of stabilizing morale and reducing consequences. In the meanwhile, it is a typical manifestation of "excessive regulation" for those colliery enterprises which maintain good safety level and standard safety management mechanism when either an appropriately reduced suspension time should be applied or there is no need to execute the order otherwise. During this period, that the overall regulation system is on high alert helps present a high-level operational phase. With the diminishing impact of the accident, the regulators are subject to a variety of economic interests and the temptation of performance evaluation mechanism. What’s more, illegal behaviors of local officials who abuse their power and are in collusion with enterprises contribute to a weakened regulation. The fact that colliery safety hazards cannot be found timely and that no serious enforcement measures would be taken even though investigated can only lead to the tragedy of the coal mine accident. Since regulating fluctuations involve a wide range of complex causes and serious damage, in means significant to pay more attention to safety regulation fluctuation and to do further research on it in order to guarantee better running of coal mine safety regulations at a stable level and to avoid the breeding of colliery safety hazard.On the basis of existing colliery safety regulation system research, the thesis resorts to a large number of references and real-time case. After summarizing the influences of regulation fluctuation on colliery safety the essay reflects the latest statistics in chart form to confirm the phenomenon of regulation fluctuation. In addition, it makes use of Game Theory and Game Model in the process of analyzing the causes of regulation fluctuation. More convincingly, the author selects some typical cases to illustrate and link the theory with practice thus highlighting the severe hazard of regulation fluctuation. Then reasonable countermeasures are proposed based on knowledge of colliery safety regulation and results of authoritative scholars’research. This thesis resorts to the latest data from the official websites of State Administration of Quality and Technical Supervision and National Bureau of Statistics, with data analysis software such as EXCLE and SPSS, visually certifies the ubiquity of regulation fluctuation and analyzes the colliery safety regulation state in a theoretically detailed way; The thesis demonstrates the hazard to colliery caused by regulation fluctuation through the typical cases with important and representative statistic data. It illustrates that the negative effects of regulation fluctuation is always playing a harmful role in the life safety of miners, national economy and even to the whole regulation system.Thirdly, this essay analyzes the factors of regulation fluctuation by Game Model. According to the mutual game relationship among central government, local government and colliery enterprises, it builds up a Game Model to analyze the forming process of regulation fluctuation in a deeper sense. By studying two aspects of regulation and deregulation respectively caused by separate and integrated functions of government and enterprises, it finds out seven factors that causes regulation fluctuation. That is, administrative accountability system, public pressures, information asymmetry between central and local government, the stimulation of incentive mechanism of economic benefit and performance evaluation, the shortage of penalties, and unsound laws and regulations.Fourthly, it proposes reasonable solutions. By analyzes the causes and hazards of regulating fluctuation and absorbs the research achievements of domestic and overseas senior scholars, it resorts to the regular pattern and result of coal mine accidents over the years. In compliance with present development status of regulation fluctuation, it puts forward many countermeasures, such as to set policy target, to reform and encourage compatibility system, to standardize coal mine regulation system, to strengthen regulatory efforts and input costs, to cultivate the supervision force and to make up the vulnerability of laws and regulations, all of which have a constructive meaning to stabilize the level of safety regulation and to curb the frequent occurrence of coal mine accidents.At last, it briefly concludes the whole thesis and focuses on deficiencies and prospect for future study.
