Travel consumers, as important members of travel agency stakeholders, are both contradictory and interdependent with travel agencies. Travel agencies, however, often sacrifice consumer rights and interests in market transactions to meet their own interests. Current relevant tourist laws and regulations are not powerful enough to protect all the tourists’ rights and interests. Therefore, it is necessary to make research on the conflicts between protection of travel consumers’ rights&interests and benefits of travel agencies in order to reduce the damage of tourists’rights and interests.Protection of travel consumers’rights and interests means to help travel consumers to meet their travel needs, namely, get access to cheap and enjoyable travel products, while travel agencies are to seek cost reduction and profitability. The conflict between travel consumers and travel agencies focuses on economic interests. In the eyes of tourists, travel agencies, when driven by interests, will do misbehavior, such as lower service standards, hide tourist information and enforce consumption. When travel consumers feel dissatisfied with the quality their travel products, they request the compensations from travel agencies, travel agencies always find excuses to lessen or exempt from liability.Current research on protection of travel consumers’rights and interests focuses mainly on law. This paper emphasizes mainly on the conflicts between the rights&interests of travel consumers and the benefits of travel agencies to discuss the particularity of the conflicts between travel agencies and travel agencies as well as solution strategies.Research results has shown that the homogeneity and utility of the products provided by travel agencies does not comply with the price, travel agency business capacity can not meet consumer demand, the connation of travel products goes beyond consumers’health capacity, and non-equality of the subject status. These conflicts undermine the rights of travel consumers, such as legal equal status, product selection, personal security, fair trade, right to know and so on. Conflicts lie in that travel consumers expect joyful travel experiences, but travel agencies expect the greatest profits, the purpose of both conflicts. Manifestation of conflict mainly reflected on the economic disputes, because travel consumers want low prices, travel agencies have to sell them the products at low prices. In order to make up for the losses for profits, travel agencies have to lower service standards, enforce travel consumers to spend more in the way of infringement of rights and interests of travel consumers.Solutions are suggested to avoid and reduce the conflicts:perfect the travel-related laws and regulations, strengthen the management and supervision of the industry, strengthen self supervision and management, build product evaluation mechanism, reduce the homogeneity of travel agency products, innovate products to make a profit, improve travel consumers’ awareness and keep rational consumption, unify common interests goals,, and rational coordination of conflicts.
