Research On The Protection Of Farmers' Rights And Interests In Farmland Transfer

The issue of agriculture,rural areas and farmers is a fundamental issue concerning the national economy and the people's livelihood.Among them,agricultural land is the key to the three rural issues.Agricultural land transfer can promote the adjustment of agricultural industrial structure,promote rural revitalization and increase farmers' income.Therefore,agricultural land transfer plays an important strategic role in solving the problems of agriculture,rural areas and farmers in China.As the main body of China's agricultural revitalization and rural development,farmers' legitimate rights and interests should be effectively guaranteed in the transfer of agricultural land,which can not only guarantee the life of farmers,but also add impetus to the development of modern agriculture and the construction of a new socialist countryside.However,according to the actual situation of farmland transfer in various regions,farmers' legitimate rights and interests are damaged to varying degrees,which not only causes great troubles to farmers' production and life,but also brings great challenges to promoting orderly farmland transfer,developing modern agriculture and realizing rural revitalization.Therefore,it is of great significance to focus on the problems existing in the protection of farmers' rights and interests in different types of farmland transfer,deeply analyze the internal causes of the problems,and on this basis,extract countermeasures and Suggestions for the protection of farmers' rights and interests in farmland transfer.This paper selects Batang Town,Bishan District,Chongqing City as a case study.Through field research on the current situation of farmland transfer in Batang town and the difficulties in the protection of farmers' rights and interests in the process of transfer,countermeasures and suggestions are put forward to protect farmers' rights and interests in the farmland transfer based on relevant marxist theories.The paper is divided into five chapters.The first chapter clarifies the research background and significance,systematically sorts out the current research status of farmland transfer and farmers' rights and interests protection at home and abroad,defines the core concepts,relevant theories,research ideas and research methods.Chapter two and chapter three divide the transfer of farmland into two categories: decentralized transfer and centralized transfer according to the field investigation of Batang town.Through typical cases,this paper analyzes the effective measures and shortcomings of protecting farmers' rights and interests in different circulation types.The fourth chapter analyzes the reasons why farmers' rights and interests are damaged in the process of farmland transfer,including unclear definition of rural land property rights,stunted development of land transfer.The fifth chapter combines the analysis of the damage and reasons of farmers' rights and interests in Batang Town,and discusses the new ideas to protect farmers' rights and interests in farmland transfer from the aspects of clarifying farmland property rights,positioning the role of the government,perfecting the social security system and improving the ability of safeguarding rights.
