Study On The Legal Regulation For The Orderly Development Of The Rare Earth Resources

Tombarthite is, comprehensively applied in agriculture and industry, very important mineral resources.Chinese is one of the countries which own abundant tombarthite resources in the world. As strategicresources, tombarthite play a vital role in development of economy and improvement of International status.however, many problems are existing in development of tombarthite, such as: out of order exploitation,environmental pollution and so on. The main reason resulting in those problems is defective managementsystem and legislation of tombarthite resources.In order to regulate exploitation of tombarthite resources, this paper presents many methods andsuggestions, according to experience and inspiration from aboard exploitation. First, although exploitationof tombarthite has gone through several decades, many problems are existing in development oftombarthite, such as: out of order exploitation and rare supervision. Second, taking advantage of aboardeffective experience to strengthen awareness of strategic reserves and control domestic and aboard market.Third, these is not enough laws and regulations to solve the problems resulting from exploitation oftombarthite. So establishing and perfecting legal regulation, which needs work from two sides: one is toestablish legislation on the basis of regulations of tombarthite exploitation. The other is to strengthenenforcing the law, clear and definite rights and obligations among enterprise, administrative machinery andlocal government at various levels. Meanwhile, strengthen supervisory system, establish linkagemechanism, carry out the responsibility and perfect responsibility investigation mechanism. The awarenessof protecting tombarthite resources will be improved by propagandizing the concept protection ofresources.
