On C-E Business Contract Translation From The Perspective Of Functionalism

As an important legal basis to commence business and safeguard rights and interests of relevant trade parties, business contract plays an increasingly important role in business activities with its normative expression, rigorous logic and clear contents. The business contracts this paper is going to analyze are C-E translations of mortgage loan contract and construction supervision contract. It is hoped that this paper could sum up the characteristics of the contract texts and translation strategies and contribute to the translation of mortgage loan contract and construction supervision contract through analyzing C-E translation of those contracts in translation practice.This paper selects three contracts "Mortgage Loan Contract of Shaanxi XX Real Estate Company Limited","Mortgage Loan Contract of Shaanxi XX Medical Instrument Company Limited" and "Construction Supervision Contract" as the main focused research objects. The paper tries to find out the way of choosing and applying proper translation methods and techniques in translation process from the perspectives of linguistic and text characteristics of business contract with the guidance of functionalist translation theory.This paper includes four chapters. The first chapter is the introduction part, which states the representatives of functionalism and their perspective opinions, the brief of characteristics of C-E business contract translation, and raises hypotheses of using functionalism to guide the C-E translation of business contract. The second chapter is the description of C-E contract translation, which covers the detailed tasks and their translation process. Chapter three analyses the C-E contract translation task, including the selection of guiding translation theory and the analysis of translation methods and techniques under the guidance of the selected translation theory. Chapter four serves as the conclusion of this paper.
