In the1970s, it has been discovered and ascertained that the area ofSouth&East China Sea is rich in oil and gas resources, etc. And accordingto the provisions on the Exclusive Economic Zone (EEZ) and ContinentalShelf (CS) of the United Nations Convention on the Law of the Sea1982(UNCLOS), the coastal states may exercise exclusive jurisdiction andenjoy exclusive rights including fishing and mining of oil and gasresources in the area of the said EEZ and CS. Thus, certain disputes havearised between relevant countries including China around the area of South&East China Sea. Focusing on the said disputes, a comparative study onboth substantive issues and procedural issues will be conducted, andfeasible suggestions on the resolution of the above mentioned disputeswill be provided in this thesis.This thesis is composed of five chapters.To begin with, the historical background and general situation of thesaid disputes are introduced in the preface, and the geography postureof South&East China Sea with the genesis and cause both internal and external of the said disputes are explained in the first chapter. Next,the legal basis and principal of the real issues of the said disputes areanalyzed under the comparative study from a substantive viewpoint in thesecond chapter. Subsequently, comparative study focusing on the solutionsand procedural mechanisms of the said disputes is produced and acceptableformula for settling the disputes are provided according to the currentsituation and the relevant agreements among the countries in the area ofSouth&East China Sea in the third chapter. Finally, the relevant standingprovisions and practices of China are introduced and the main problemsin respect of maintaining and defending sea rights and interests of Chinaare analyzed in the last chapter. In order to tackle the problem, certainmeasures are also provided in the last chapter.
