Research On Legal Construction Of China’s Urban Community

With the continuous development of China’s economy and urban modernization,together with the deepening of economic reforms, especially the transition from theconcept of people belonging to a specific unit to people integrating into society, citycommunity construction has gained more and more attention from both government andordinary people. At present, great success has been achieved in China’s communityconstruction. Firstly, urban community organization system is initially established, and thesystem of community residents’ committee and residents’ council is also widelyestablished throughout China. Secondly, the administrative and operative system in urbancommunity construction has been formed and starts to run. Lastly, legal service system incommunity is partially established, correspondingly administrative team with Chinesecharacteristic for community construction is also formed.In contemporary China, rule of law is the fundamental system, and is also thecivilization achievements of human progress, without which China would not achieve thegoal of modernization. And legal system constitutes the b asic part to rule of law. If there isno comprehensive law, there is no rule of law. By the same token, as a necessary part ofChina’s modern construction, urban community construction also needs law. In urbancommunity construction, law construction as an important part of community construction,cannot be neglected, because it provides community construction an important guarantee.At present, establishing a comprehensive legal system, is the foremost work in communityconstruction. It helps to the healthy development of community construction, and helps toform a healthy environment with safety, orderliness, democracy, and fairness.The whole thesis can be divided four chapters, namely introduction, the main bodyand conclusion, totally about25000characters.The first chapter introduces the emergence and development of community. Bycomparing the meaning of community in different countries, and on the basis of analyzing the present situation, community’s construction and development of China’s urbancommunity construction, the chapter explains in details the connotation of China’s urbancommunity in a specific environment, and provides coping strategy.The second chapter mainly explains the function of law during the construction ofChina’s urban community. Because in the process of development in urban community,the model transformation of urban community should be confirmed by law. And thecommunity construction needs a safe, orderly, democratic and fair environment ruled bylaw. Furthermore, to achieve the goal of community autonomy, and to carry outautonomous activities, we still need the safeguard sent by law. So all of the above showshow important the law is in the construction of urban community construction.The third chapter discusses the problems of legal practice and the legal systemconstruction of urban community development at present stage. Community building inChina experiencing60years of practice, has made great progress and formed the modeconstruction with Chinese characteristics. But the legal construction did not get the samedevelopment comparing with the urban community construction which made the urbancommunity construction without the legal protection. This lies in following aspect: therelationship among governments, residents committees and residents does not get the legaldefinition which results in the confusion of construction, abuse of administrative power,and no protection for residents basic rights. In the urban community building process, thelegal system, the relative lack of existing legal system and cannot cover all aspects ofcommunity building, while the legal lower level of legal authority is relatively weak, theexisting laws and regulations cannot be effectively implemented. These problems haveseriously hampered the development of urban communities.The fourth chapter elaborates on the recommendations of the legal systemconstruction of China’s urban communities. This chapter is the focus of this paper and isalso the difficult point of this paper. In this section, for the case of MetropolitanCommunity，legal system is relatively scarce, and it is recommended that the proposal to develop a comprehensive legal system, to elaborated the principle of legislation, todetermine the legal status of each main form of law, and clearly defined in each subject therelationship between the legal system, develop a higher level escort for the construction ofa harmonious community. The focus is the development model based on the idea ofinnovative urban community, to establish the autonomy of government guidance andurban residents. Legal construction of urban communities include: to develop and perfectthe legal system and urban community development, construction of legal servicesmechanisms and urban communities, building safety and security of the legal system. Soas to achieve a legal basis in the urban community building process. Urban CommunitySelf-building is an important content of the community building can be achieved inaccordance with the law of autonomy is the key to the construction of urban communities,so the development of a resident in accordance with the law of autonomy law is a toppriority of the urban community building, Therefore, in accordance with the reality of thesituation of the urban community building and internal needs, it is recommended theenactment of the autonomy of the Community of the People’s Republic of China, andprovide a legal basis for community self-government as soon as possible.
