In an age of economic globalization and regional economic integration, regionaleconomic cooperation is booming. As a typical type in our domestic regionaleconomic cooperation, the pan-pearl river delta regional economic cooperation isdeveloped mainly by means of intergovernmental agreements which are signed by thelocal administrative organs. The intergovernmental agreements in pan-pearl riverdelta regional economic cooperation are reached by the local administrative organs onthe basis of consensus, which are related to the sphere of administrative functions ofthe local administrative organs. As a new thing which is developed from the practiceof the regional economic cooperation, the present law makes no provision for theintergovernmental agreements. By analyzing the text content of intergovernmentalagreements in pan-pearl river delta regional economic cooperation, this article pointsout the existing legal problems in practice intergovernmental agreements, such as lackof legal basis, indeterminacy of legal force, no subject qualification, lack of publicparticipation and approval procedure, lack some important clauses and vague andgeneral in content, lack of liability for breach of agreements and dispute-resolvingmechanism and so forth. Then this article advances a few targeted advices from alegal viewpoint to perfect intergovernmental agreements in pan-pearl river deltaregional economic cooperation, with an aim to provide some salutary references fornormative application of intergovernmental agreements in pan-pearl river deltaregional economic cooperation.
