Such as "Sole Proprietorship Enterprise Law, thePartnership Enterprise Law" is the instance. Marx had said:"The market economy isto promote human development and progress of the independence of the economy."People in market economy conditions, participation in economic activities, whileavoiding disadvantages of enthusiasm and initiative in order to be given full play.Mankind has only individual liberation, the full release of the passion to reachcommon expectations.SMEs are an important part of our social and economic development, is the basisof force to promote national economic development and promote social stability.Number of small and medium enterprises in China accounted for more than98%ofthe total number of enterprises, total assets of SMEs, the proportion of output value ofmore than60percent, providing jobs to more than75percent, from these data attest tosmall and medium-sized enterprises have already become one of China’s economicdevelopment important source of strength. China should attach importance to thedevelopment of SMEs. But over the years, small and medium enterprises of their owndevelopment but there are many problems, such as backward management system forSMEs, financing difficulties, weak innovation capability, structure and layout of unreasonable, especially after the global financial crisis. The impact of globalfinancial crisis on SMEs in China can be summarized as "three small": a large impacton labor-intensive enterprises, small high-tech enterprises; impact of foreign tradeexport-oriented enterprises, small impact on the inward-oriented enterprise; nostrategy to prepare the business impact, ready enterprise. The overall world economicslowdown triggered by the financial crisis lead to China’s external demand decreased,the decline in exports, China’s export-oriented SMEs facing a major test.Gradually in the past in the most difficult times of financial crisis, the worldeconomy began to pick up momentum after the financial crisis era, the world is as"post-financial crisis era" a new round of global economic structure and organization.Domestically, the economy has entered a critical period of warmer, but there are stillmany uncertainties, full recovery is still struggling. In this context, China’s SMEs, thepost-financial crisis era is the era of both opportunities and challenges, how SMEs canseize the opportunity to change ideas, out of the shadows, re-positioning to meet thenew round of development, China economy to achieve sustainable development hasimportant practical significance. Face the future, small and medium enterprises tosolve many problems, in order to effective development, and this requires theGovernment to provide public goods beneficial to their development, removeobstacles that hinder its development; the other hand, need to seize the opportunitywithin the scope of the legal system learn profound lessons, innovation, adhere toscientific development, and thus play an important supporting role for the healthydevelopment of the national economy. Of great significance for the study of small andmedium enterprises, we want to go into the reasons that hinder its development, tocome up with effective solutions and research methods.Chinese scholars mostly based on small and medium enterprises over the yearsthe development of SMEs experienced the status quo after the global financial crisis.But less for the development of the economy has entered a new period of SMEs, butthis period is a critical period of development, the emergence of new problems in theaftermath of the financial crisis. SMEs are becoming increasingly important inmodern economic development, this paper, we propose the development of SMEs and the status quo, the status and role of SMEs, SMEs existing problems, to solve thecountermeasures of the problem and the associated financial laws and regulationaspects. Asked the outstanding problems and needs of all sectors of society worktogether to address how to enhance innovation capability, and control enterprise risk,and to broaden the financing of SMEs, to change the financial structure and layout, toimprove the financial legal system research This thesis is dedicated to the research.Mainly want to broaden the development of SMEs through the study of the problem.To build efficient public service platform for the development of SMEs. Especially toincrease the improvement of relevant laws and regulations, in-depth development ofSMEs in terms of system security. This study originated from the surface and thepoint to grasp the accurate, trying to highlight the actual reference of the paper, thetext negates the development of SMEs in the various aspects and to demonstrate theeconomic law areas under the financial legal system.
