Since the reform and opening up policy established, our country market economyare having a huge development, including the increasing of the proportion of the mixedownership economy and private economy, so labor relations is more complicated thanbefore. For resolving the disputes, China has enacted a number of laws and regulations,and established the current labor dispute settlement mechanism. But, according to thesituation, our country labor dispute settlement mechanism has many problems, and needto be perfected. According to the China statistical yearbook2012, the labor disputecases accepted in2011is to589244. Over more than five hundred thousand of the labordisputes, if not be solved properly, not only having bad influence to building aharmonious labor relations, but also to our country’s social stability. Therefore, creatinga scientific of the diversity labor dispute settlement mechanism is an urgent and arduoustask.Diversified labor dispute settlement mechanism must comply with the labordispute resolution principle, which is timely; emphasize the principle of mediation;based on facts and legal principles; equal treatment. The goal of the Diversity labordispute resolution mechanism is to realize the fairness of controversy and buildharmonious labor relations. Harmonious labor relations is not means eliminated thelabor disputes, but means after the labor dispute, both sides of disputes can achieving aequal dialogue and making a compromise in order to realize the coexistence. Thereforeestablishing diversified labor dispute resolution mechanism is for the purpose ofproviding a reasonable compromise platform.The first part of this article is mainly analysis theory of the diversity of labordispute settlement mechanism, to lay the foundation for the whole writing; The secondpart is to analysis the number of labor dispute cases in recent years of our country,making the current status of labor dispute clearly; The third part is a analysis of thepresent situation of our labor dispute settlement mechanism; The fourth part is to drawlessons from foreigners and give some advice to our country.
