In the rapid development of China's market economy,the labor relations in the transitional period with the market economy are emerging.The number of labor dispute cases is huge,the collective labor disputes are frequent,and are in rapid growth.This has seriously endangered the development and stability of the society and economy.As a newly rising industrial and commercial city in the Yangtze River Delta area,KS city has been sitting on the excellent geographical position.It has been appraised by the National Bureau of statistics for the first time in the past hundred years by the National Bureau of statistics,the most powerful County in the country.It has been proud of GDP for many years.However,with the decline of global economic situation,many export oriented enterprises,electronic information enterprises and labor-intensive enterprises in KS city face or upgrade the problems of production equipment and transformation,so the growth of labor disputes is also increasingly prominent.Based on the zone KS from 2013 to 2017 the labor dispute arbitration case analysis in this study,the characteristics that KS labor dispute is: the number and the increasing trend of labor dispute;diversified development;requirements of labor compensation and economic compensation become a universal pursuit;lack of social integrity resulted in malicious demands rise;labor disputes frequently occur in manufacturing and service industries;the number of collective disputes because of the "off,stop,and,turn to rise;workers win rate higher.After investigation,it is found that the main reason for labor disputes is not perfect rules and regulations,personnel management is not in place,and employers fail to comply with relevant laws and regulations.However,after labor disputes,workers lack legal knowledge and appeals.The lack of independence and discourse power of trade union and grass roots coordination organizations is the reason for more arbitration and litigation.Therefore,it is necessary to establish and optimize the existing mechanism for handling and preventing labor disputes.Then from the main body,first of all is the workers need to sue the law consciousness and practical ability,the enterprise should strengthen the construction of enterprise management system,establish and perfect the reasonable wage adjustment mechanism and strengthen the laborer democratic participation,establish smooth communication channels,to enhance its independence so as to promote the internal mechanism of negotiation.Secondly,the establishment of the mediation organizations,such as the enterprise mediation committee and the grass-roots level coordination organization,should be established.Once again,the government should promote the publicity and implementation of labor laws,strengthen the improvement of labor dispute mediation organizations,improve the labor arbitration system,strengthen the labor and social security supervision mechanism,and promote the effective operation of the three party consultation mechanism.By building the above diversified and comprehensive labor dispute handling and prevention mechanism,we will reduce the occurrence of labor disputes in the KS Economic & Technological Development Zone,alleviate and solve the labor disputes,and establish a harmonious labor relationship in the KS City Development Zone.
