Research On Public Execution Of Death Penalty

Transparent judiciary not only relates to a national justice system good or not, but alsoconduces to the protection of the parties’ procedural rights in criminal procedure. Executionof the sentence is the final manifestation of the national power of punishment, therefore, forthe purpose of promoting the public justice the state must emphasize the penalty programsopen. In our theory for transparent judiciary is more emphasis on public criminal trial. For theexecution of the death penalty, it is more emphasized that the death penalty execution is secretand not public. There is not enough to study the system theory of the death penalty executionin public. In recent years, with the development of information technology, increasinglypeople highly demand for the execution in public, particularly for the death penalty which issevere and irreversible. With exposing the death penalty criminals’ personal information andexecution places in Japan, and broadcasting death penalty execution process by television inUnited States, international society discuss more about the execution in public.This article is divided into seven parts which it includes preface, overview, comparisonand reference from the system of United States and Japan, the level of Chinese death penaltyexecution in public, the improvement of Chinese death penalty execution process, concludingremark. The anterior four parts mainly introduce the topic and current situations of research athome and abroad (most examples are from United States and Japan); the later three partsindicate the key opinions and purposes of this article.In this article we prove that the public execution is right or not in China by analysis,comparison and integrating theory with practice. Through demonstrating the influence topublic people, analyzing the pluses and minuses to the society, considering the reasonable ofChinese judicial practice, we expect to perfect the system of death penalty executions forprotecting the criminals’ fundamental human rights and finally promote abolition of the deathpenalty in China.
