With the irsing of the modern media means,the growing of the network technology,thepublic began to actively participate in the judicial activities, the public opinion incontemporary Chinese justice system has irsen to a position that can not be ignored. Theeffect on public opinion of the administration of justice is irght or wrong, large or small, thecommunity on this issue is controversial, which has also become a focal problem in the lawacademics in recent years.I think that the participation of the public opinion has become animportant patr in our judicial system,and it did play a beneficial function of judicial. But at thesame time, public opinion is a double-edged sword,its “excessive intervention" on the judicialbodyjudicial behavior and judicial outcomes may bring the pressure of the public opinionandthe interference of public opinion?thereby affects on judicial independence,impartiality andauthority.Through some typical cases in recent years,we can roughly be seen,the People’s Courtand its judicial activities in the public mind has been at the cornerstone of a "shaky" trust.Where is the cirsis come from? And how to deal with the relationship between public opinionand justice? Around this seires of problems,this article begins.Based on the resolution of thecase of Yao Jiaxing,the article reproduction the situation of opinion to interfere in judicialactivities and impact of judicial impartiality and judicial independence,and then explore howthe effect is produced,and put forwad some resonable and feasible solution to alleviate thetension between public opinion and the judicial.The paper is divided into four chapters. The first chapter introduces the basic facts of thecase of Yao Jiaxing and discusses about the issues in it. The second chapter focus on theintersection of public opinion and judicial in the case.The third chapter researchs of the effectof the public opinion in all aspects of the administration of justice,and combined with the caseof Yao Jiaxing.
