Abstract/Summary:
Our mainland ended the history of not having any highway since the first highwayopened in1988. In the following several years, our country completed the construction ofmany highways, in which the Shenyang-Dalian highway is the first highway in its true sensein our country. It symbolizes a new era of the development of highway in our country becauseof its totally-enclosed two-way lane. By the end of2011, our country’s highway trafficmileage has added up to850,000km, ranking the2ndall over the world. At the same time,highways are playing a more and more important role in the economic construction andpeople’s daily life. But in our country there is no such a perfect administrative managementsystem to match with the growing importance of highway. Generally speaking, the presentmanagement of highway in our country is relatively disordered. The management of thehighway is not conducted by a unified organization. On the contrast, it depends on thedevelopment of respective cities and provinces. Many changes of the law enforcement of thehighway have occurred over20years with the development of economy and the reform of theadministrative organizations. Now, in the field of administrative enforcement of law,integrated law enforcement is becoming a hot topic. Many scholars think that integrated lawenforcement is a necessity to prevent the divided policies from various sources and thedisorder of the management. Most of the scholars focus on the integrated enforcement or thehighway enforcement, and few of them discuss the reality that we can apply the integratedenforcement into the highway enforcement. The transport agencies are always diverse andcomplex, especially the highway, a newly sprouted thing, many of whose systems are still inthe trial sub stage. Trying to provide a starting point of how to solve the problem of theintegrated law enforcement of highway, my paper attempts to do some states of thisenforcement system using the Case Analysis Method and the Comparative Analysis Method.The body part of my paper mainly discusses from the following aspects.Part one: Give an impression of the current state by making a brief description of theresearch contents. Part two: Analyze the historical reform of the highway integrated lawenforcement; give the legal explanation of some terms; explicit the tendency that theintegrated law enforcement becomes the highway law enforcement in our country. Part three:Probe into the existing problems during the highway integrated law enforcement analyzed by cases. Part four: Speculate the problems during the highway integrated law enforcement inour country and analyze the challenges in practice and theory combing foreign successfulexperience. Part five: Straighten out the relationship between the highway law enforcementmain body and the highway administrator through the innovation model of the highway lawenforcement of our country.
