Research On Legal Issues Concerning Cosmetics Security Supervision In China

Since China’s reform and opening-up, all kinds of cosmetics are becoming household items with the rapid development of China’s cosmetic industry. In recent years, due to frequent occurrence of cosmetics accidents, cosmetics safety issues are getting more concerns from the society. On one hand, China attaches great importance to cosmetic security supervision, issues lots of legal documents to form a relatively complete legal system and establishes relevant regulatory authorities to ensure the healthy and orderly development of cosmetics industry. On the other hand, we should also note that there are deficiencies in the regulation of the cosmetics industry. The issues that the legal systems of cosmetic security supervision are confused and laggard, and repeatedly supervised by different department are emerging gradually. Therefore, it is very significant to learn from the experience of some developed countries and regions to improve the system of cosmetic security supervision as well as ensure cosmetics safety in China.The European Union owns the biggest cosmetics industry markets in the world and its cosmetics security supervision system is in world’s leading position, which has become the chief source of laws and regulations on cosmetics in many other countries around the world. Its supervision and management model on cosmetics, for instance, enterprise self-discipline mechanism, perfect products filing and safety guarantee systems, the emphasis of identification information integrity and the great influence of industry associations, can be used for reference by our country to improve and enhance the cosmetics supervision level.This dissertation is divided into four parts:the first part gives a basic theory of cosmetics and its security supervision, focusing on the concept, classification of cosmetics and the legal definition of its security supervision; the second part expounds the cosmetics security supervision in China, focusing on China’s legal system, supervision departments, supervision model and problems in practice; the third part formulates the cosmetics security supervision in EU, focusing on its legal system, management departments and features; the final part puts forward the corresponding countermeasures according to the issues of cosmetics security supervision in our country on the basis of EU’s experience. I hope the research of this dissertation can provide useful suggestions for the cosmetics safety supervision in our country, and can be beneficial to the healthy and orderly development of cosmetics industry and the protection of consumers’rights.
