Comparative Study Of China And Eu Cosmetics Regulations And Standards System

With the rapid development of the society and the economy, consumers concentrate highly on the hygiene and safety of cosmetics. The manufactures and administrative departments are facing new situations and challenges. The current cosmetic regulations and standards cannot adapt to the present requirements of hygiene supervision any more.This thesis summarizes the status in quo of regulations and standards associated with cosmetics in china and EU. We concluded the problems in cosmetic regulations and standards and weakness in cosmetic supervision by comparing and analyzing the following aspects---the legal position of regulations and standards, procedures and methods for establishing, amending progress, examining and approving system, definition and classification, label and labeling, supervision system, measures and degree of punishment, monitoring of adverse reaction to cosmetics, quality control methods for microorganisms, substances which is forbidden or restricted in cosmetics, cosmetic safety assessment. The problems in cosmetic regulations and standards and weakness in cosmetic supervision are concluded as following:(1)the cosmetic supervision lacks support from laws;(2) cosmetic standard system is imperfect;(3)cosmetic regulations and standards are not amended timely;(4)lacking of working mechanism in the safety evaluation of cosmetics;(5) the regulatory approach cannot meet the needs of modern cosmetic safety management; Finally, on the basis of learning from the experience of the European Union, we put forward the reasonable suggestions on perfecting the regulations and standards system as follows:(1)To amend the "Regulations on cosmetics" as soon as possible;(2)Further improve the cosmetic standards system;(3) to establish professional research institutions of standards and cosmetic safety evaluation agencies. (4) Weaken the administrative license, establish long-term regulatory mechanism and respond to safety incidents properly;(5) to achieve the unity of nature and feasibility during developing standards.In this thesis, we also surveyed some cosmetic companies about the awareness on monitoring and reporting of cosmetic adverse reactions, aiming to find out the degree of awareness about policies, administration and technical requirements on cosmetic adverse reactions in cosmetic companies in our country.
