The publishment and implementation of the <Labor Contract Law> opened the startingpoint of labor relation collective adjustment, and build up the base for labor relation collectiveadjustment in law aspect. Accompany the government are striving for elimilating the gapbeteen rich and poor, building up the concern of harmonious industrial relation and socialrelation, the law also regulated the both side of labor and capital to set up salary throughcollective wage negotiation system. Under this historical background, lots workers use themost powerful way(strike) to push the capital side sitting down on table for solving thedisputes of labor, wage, welfare issues etc, it lead to many labor disputes especially strikesblowout in China.The thesis is quite important for learning how to have good labor relation, how to avoidstrike, how to avoid the destruction of strike and achieve harmonious and win-win laborrelation。There is not so much study of strikes through enterprise human resource aspect indomestic academic world. I worked as a General Manager in a German capital company forfive years, handled and witnessed two big strikes of the three. After strikes I had depthinterview with related workers, local labor bureau offices, labor unions. My study resource isquite direct, and it is very important reference for enterprise.This thesis tried to find way to solve strikes problem through Clark cases study. Clark isan German capital company located Foshan city, Guangdong province. Different from manystrikes happened company, Clark is better in salary, welfare, social responsibility in hisindustry. In2008, Clark has her first histrionic strike after <labor contract law> issued. In2010, Clark is the one of strike occurred foreign companies in local. In2012, Clark has herthird strike, become the most strikes company in local.This thesis used many theories of labor relation management and human resourcemanagement. For example, the conflict and cooperation theory of labor relation, thecommunication theory, the labor discipline theory, the psychological contract theory, the laborunion and wedge collective negotiation theory, the salary system theory, performanceassessment theory to analyze the reason of strike and find solution. This thesis usedquestionnaire method, document analysis method, depth interview method to analyze thecases, and find out the reasons for three successive strikes: mistake in salary calculation ofHR, non-suitable payment system and payment construct, few performance assessment, poorlabor discipline, lack bridge of communication, wrong treatment in strikes leading to reserve incentive function for successive strikes,unhamorious relationship between capital and laborside. Based on the analysis, the thesis proposed the solutions: seriously disciplinemanagement based on regulation, execute incentive performance assessment salary, build uplabor bureau as the bridge of communication, use wedge collective negotiation system tosolve wedge bargaining issue, reduce enterprise scale to reduce risk, treat employees well andbuild up harmonious capital and labor relationship etc.
