Humanistic Foundation Of Legal Protection For Social Vulnerable Groups

The problem of social vulnerable groups is a world wild issue that cannot be ignored. Social contradictions caused by social vulnerable groups problem emerged in an endless stream. Since China is in a social and economic transformation period, the problem of social vulnerable groups that China facing presents a more and more complicated trend. In order to solve this problem, legal protection is one of the most suitable ways. And the fundamental theory of law for protecting social vulnerable groups based on China’s reality has a direct influence on the rationality and strength of legal protection. In this thesis, we start from the angle of people-oriented and discuss respectively three aspects of legal protection for social vulnerable groups include intellectual foundations, value basis and development direction.The first part introduces domestic and foreign scholars’ definition of social vulnerable groups and points out the basic reason of protecting these groups. It also defines the objects of this research as well as the features of these objective social vulnerable groups. The second part states the people-oriented idea in ancient China, the Western Humanism, Marxism’s idea on humanism and the content of people-rooted thought in China’s socialist construction; it reveals the thoughts of legally protecting social vulnerable groups in these sources. While the third part states from both individual attribute and integrity attribute that people-oriented theory is the human rights and harmony value basis. We hold from the nature of life, the essence of freedom and the character of equality that people-oriented theory is the value basis of life, freedom and equality of legal protection for social vulnerable groups. In the last part, we show the development direction of legal protection for social vulnerable groups under the guidance of people-oriented principles and methods.
