Humanistic Foundation Of Legal Protection For Social Vulnerable Groups

With the developing period of social transformation, Chinese consciousness of liberty, democracy and human rights has been improved. The law construction needs theory to guide the law in the new era of the humanistic spirit. Accordingly, people-oriented concept of law was produced. As the important generalizations and the theoretical essence of a law theory about humanistic view, the research in Paradigm of viewpoint of humanist law give an advantage to understanding and grasping the humanistic view of law theory and play irreplaceable role on the development and innovation of the theory to the people-oriented view of law. And at last it can accelerate the construction of building a socialist legality country.In this paper, further research and Discussion on the theoretical system framework of the Viewpoint of Humanist Law consisted of three parts。This thesis fully discussed the theory system of Paradigm of viewpoint of humanist law, including three parts.In the first part, thesis showed the concept and characterization of Paradigm of viewpoint of humanist law, demonstrating the rich connotation of the legal concept of human paradigm theory. Nest, thesis reviews the people-oriented view of law view of historical process and theory of paradigm transformation, which lay the foundation for understanding the whole theoretical system of the Paradigm of Viewpoint of Humanist Law.In the second part, thesis analyzed and revealed the content of theoretical system of the Paradigm of Viewpoint of Humanist Law, including the connotation of "people-oriented", theory origin of Viewpoint of Humanist Law, category system and alienation of the law. Above all, thesis established the paradigm theory system framework of viewpoint of humanist law.In the third part, thesis demonstrated core of paradigm theory of viewpoint of humanist law which is the humanistic values and humanistic analysis methodology, discussing what is humanistic value and what is humanistic analysis methodology, trying to propose the basic principle of humanistic analysis methodology. At last, thesis proposed the method of applying this Law Paradigm’s way of thinking to solve the legal problems in theory and practice.
