| Energy Conservation Law aims to solve the problem of the scarcity ofenergy resources and environmental externalities during the processes of energyproduction and consumption. Like any other laws, the current Energy ConservationLaw is not necessarily perfect, which is needed to be constantly improved based onthe issues reflected in the implementation process.Social relations that are adjusted by law will eventually be implemented on theadjustment of interest, while the purpose of the law is to receive a balance of interestbetween subjects. Basing on the localization of Energy Conservation Law andenvironmental regulation, this paper introduces stakeholder theory to unscramble thecurrent Energy Conservation Law in China, and puts forward some perfectionsuggestions. To be more specific, first the paper reviews the history of EnergyConservation Law as well as the subjects of interest in law during different periods.Second, the paper makes the definition of the stakeholders in current EnergyConservation Law, including the government, corporations, public and intermediaryorganizations, and then makes an analysis on the interest demand among thestakeholders. Furthermore, through discussing the conflicts among the stakeholders incurrent Energy Conservation Law, the paper draws a conclusion that the currentEnergy Conservation Law pays less attention to the public and intermediaryorganizations, and makes inefficient restriction on government power. Besides, in thecurrent law it costs a lot on keeping the peace while costs a little on breaking the lawby the corporations, and lack of the inherent motility of energy conservation, etc. Inaccordance with imbalance of the stakeholders, the paper advances some suggestionsof perfection on improving the setting of government’s responsibility, perfecting theenergy regulatory system, consummating the marketing mechanism as well aspromoting corporations on the independent energy saving. |
