The Analysis On Legal Issues Of Vetting And Review Of The Intellectual Property In Momentous Economic And Innovative Activities

The implementation of intellectual property strategy to build the innovation-drivencountry needs the intellectual property law system and policy support conforming to thepresent economic and social development.At present, there are some defects and serious lags in Chinese intellectual propertymanagement system, such as lack of intellectual property vetting and review system ofmomentous economic and innovation activities.Although some places have tried to establish relevant institution, which is still at itsinfant stage, due to severe consequences caused by intellectual property rights problems ofmomentous economic and innovation activities, there are many problems and insufficiencies.Therefore, it is urgent to do some research on the establishing and improving of theintellectual property vetting and review system mechanism on the basis of China’s reality andexperience, which is of great theoretical and practical significance to improve thedecision-making process of major economic and innovation activities, promote the healthydevelopment of the cause of intellectual property rights and maintain economic industry andnational security.Based on this, the dissertation researches into and provides new legal dimensions for theintellectual property vetting and review system and related issues of momentous economyand innovation activities.The research background and its significance is presented, and domestic andinternational researches and practices on the intellectual property vetting and review systemof momentous economic and innovation activities are illustrated in the first part.In the second part, the concept and connotation of momentous economic&innovationactivities, intellectual property vetting&review and other related subjects were analyzed.The author aims to define and try to give new meanings to the connotation of intellectualproperty vetting and review system of momentous economic and innovation activities.The importance of establishing intellectual property vetting and review system ofmomentous economy and innovation activities is also elaborated from the practical needs andsystemic needs in the third part. The basic principles and main content of intellectual property vetting and review system of momentous economy and innovation activities are expoundedalso in this part, proposing three institutional targets(Justice，efficiency and innovation) andthree basic principles(standardization, confidentiality and flexibility).The fourth part focuses on the scope of subjects of intellectual property vetting andreview system. The main functions of activity participant are defined, and the whole processis divided into two different parts, namely the basic vetting procedure and the basic reviewprocedure. And relevant legal issues in the basic procedures that need to paid attention to arealso discussed in this part. In particular, the objects of intellectual property vetting and reviewsystem of momentous economy and innovation activities are illustrated and analyzed.Evaluation points, legal risks and prevention of intellectual property vetting and review in thedomain of patents, trademarks and business secrets are explained respectively.The final part introduces and briefly analyses the regulatory mode of participantliabilities in intellectual property vetting and review process of momentous economic andinnovation activities. The supervision and inspection system and the legal liabilities ofactivity participants are also illustrated from the angle of legal regulation.
