| This paper is mainly for tobacco legal control according to the harmfulness of tobacco，and make further systematic analysis and research according to the development ofinternational legal control on tobacco，Framework convention on tobacco control，and ourcountry’s tobacco legal control.This paper is divided into four parts. Firstly it gives an explanation on tobaccoharmfulness，including the harm of tobacco fog to our health，the damage to the ecology，andthe inevitable negative effect on social that tobacco will bring. Because of these harmfulness，We must make control on tobacco. Subsequently it analyzes the indispensability of the legalcontrol on tobacco. On the second part of this paper l introduce the development ofinternational legal control on tobacco. Not only list some main countries and territory’s legalcontrol，such as America，European Union and Japan，but also explicate the connected matterof Framework convention on tobacco control. The third part of this paper mainly introducethe legal control on tobacco harmfulness of our country，firstly it illustrates our country’slegal status on tobacco control and gives a comment on its practice effect，then it analyzes thelegal tendency on Chinese tobacco control about our country’s attitude on tobacco control，Framework convention on tobacco control, tobacco lawsuit issue, etc. Lastly it put forwardsome suggestion for accelerating our country’s tobacco control system establishment. First，accelerate the process of our country’s legal tobacco control. Second，execute the principle ofpublic participation. Third, create a perfect environment for tobacco lawsuit issue. |
