With kinds of frequent natural disasters and extreme weather take place around the worldin the form of retaliation, people have to rethink the relationship with the natural environment,and come up with the concept of low carbon economy. As the foundation of the nationaleconomy industry, agriculture is an important cause to environmental damage and climatechange, but also is an important victim of global environmental degradation and climatechange. To alleviate global warming and promote agricultural sustainable development, lowcarbon agriculture is imperative. This paper uses the comparative analysis, system analysisand empirical analysis methods to study low carbon agricultural production management legalsystem. Being an important content of low carbon economy, the development of low carbonagriculture will greatly ease the pressure of global climate change, improve the ruralecological environment, and can change the way of agricultural growth, promote thedevelopment in the direction of intensive, scientific and ecological agriculture.This paper mainly put forward the idea of building low carbon agriculture productionmanagement legal system; we discuss the basic theory of low carbon agricultural productionmanagement legal system, and propose that we can build low carbon agriculture productionmanagement legal system through regimen construction.Firstly, the introduction has introduced the research background, research purpose andmeaning of the article, and the key point is the summary of domestic and foreign scholar’spoint of view, what can provide materials to analyze China’s low carbon agriculturalproduction management present situation and also can provide legislative experience andmanagement experience to build low carbon agriculture production management legal system.Secondly, we elaborate the basic theory of the low-carbon agriculture production managementlegal system; the main point is to define the concept of low carbon agricultural production andmanagement legal system; we analyze the development theoretical basis of low carbonagricultural production management legal system from the points of environmental justiceand sustainable development; we have made explicit guiding ideology and basic principle,structure and function and influencing factors of low-carbon agriculture productionmanagement legal system; above this, it has provided theoretical basis for building China’slow carbon agricultural production management legal system.
