The Study On Nomination System Of The Grass-root People’s Congress Election

The election of National People’s Congress of China belongs to “appointed election”. The currentsystem of the election of deputies to National People’s Congress, which also includes the grassrootselection, is imperfect. The nomination process in the grassroots election generates the candidate, largelydetermining the result of the election. Therefore, the nonstandard or manipulated nomination may leadto injustice and undemocracy.Considering the previous research of the nomination system of the grassroot election whichlacking of systematic and integrated study, this article mainly focus on the analysis the core content andprocedures of the nomination system of the grassroot election by studying the system of relevant lawsand policies, in order to achieve a fair and equitable election. The first part of the article indicates thesignificance of this research by summarizing the characteristics of the nomination system of thegrassroot election through the comparison with the indirect election of the National People’s Congress.The second part of the work provides the concepts of the right to vote and the right to be elected, whichlays the foundation of the nomination system with its own independent system and value. This part alsopurposes suggestions for ensuring of the right to be elected and the reforming of host organization in theelection process. The third part analyzes the problems of the nomination procedures, including the mostsevere issue in the candidacy verification. The distinction between the voter eligibility and qualificationof the candidates is suggested. In the fourth part, the author explores the legal supervision system of thenomination system and enumerates the common violations, in order to discover the completeness of thesupervision system.
