The Corresponding Policies Referring To Completion To The Supervise Of The Government Of The National People’s Congress

Supervision by the NPC system is the foundation of our political life and is also the highestauthority in the monitoring system, the mode of supervision with the supreme law of theeffectiveness in China. So the study how to improve and develop our system of supervisionby the people’s congress on government has a positive meaning to solve the present socialproblems and promote social attention to democracy and legal system. As the political systemreform in the late80’s, the theory supervision system of the NPC on the Governmentincreasingly was put on the agenda. During this period, the study mainly focused on thepeople’s congress supervision of the Government’s intention, subject, object, basic theorymethods which formed the initial theoretical framework formation of the National People’sCongress system of government supervision for further research and laid a solid foundation.In the90’s, as new generation of leadership with Comrade Jiang Zemin as the core of theparty put "the rule of law" as the basic strategy of ruling the country, the NPC system ofgovernment ushered a new round upsurge of academic in the supervision, and the work of theNPC monitoring system constantly published, so the NPC monitoring system had beendeveloped and improved at a certain degree. Since then, with as the building of a harmonioussocialist society proposed by the Party Central Committee with Comrade Hu Jintao as thecore, there has been a gap between the effectiveness of the work on the people’s congresssupervision of government and the people’s expectations and the NPC’s supervision system ofgovernment itself need to improve. Therefore, in the Eleventh National People’s Congress,Chairman Wu Bangguo stressed at the meeting "further improve the ways and means ofsupervision work with enhancing the effectiveness of supervision as the core three times." Inthis context, during the period of preparation for the master’s thesis, the author chosensupervision by the NPC system of government as a research topic to prepare.This paper includes four chapters. The first chapter is the theoretical basis of CongressionalOversight of sovereignty which elaborates the theory basis of supervision on government bythe NPC from the rule of law and sovereignty of the people. The second chapter is thedevelopment and status of the supervision of the people’s congress on government, whichreviews a rough process of supervision by the NPC system on government with "theConstitution" as the core. The third chapter is about specific issues of oversight of the NPC on government, which make a more detailed study on four problems including the part-timedeputies, the lack of the right to question NPC, the inadequate of the NPC personnelsupervision, lack of capacity for the supervision by the NPC on government. The fourth partis about specific measures to improve the system of supervision by the people’s congress ongovernment, which analyzes the existing problems concerning supervision by the people’scongress on government summarized in this paper and put forward the author’s own opinionreferring selectively foreign advanced experience and linking the situation of China, trying todo some minor tentative work in the field of constitutional government in China.
