The Protection Of Peasants’ Benefits In The Designing System Of Using Right Circulation System Of Collective Construction Land

Use right circulation system of collective construction land has been restricted in our country. The government’s collection is the only way to enter into the market. With the economic development, the leasing of state-owned is becoming harder and harder while the collection for collective land is more difficult because of peasants’ non-cooperation. Under this circumstance, it is important to find a new way for protect the peasants’ benefits and social development. In recent years, the national policy of collective construction land use rights transfer some loose. The trials of using right circulation system of collective construction land have been undertaking in many areas under state’s permission This paper is going to talk about how to reform the system of the transfer of using right circulation system of collective construction land upon the peasants’view.Besides the preface and the conclusion, it is divided into three parts:The first part points out the causes for current legislation and existing problems and reveals the phenomenon of unprotected peasants’benefits and causes by analysing the legislation and the practice of using right circulation system of collective construction land. The second part makes assessments by comparing the experiences and ways of the transfer of the transfer of the right of use of the collective construction land in Wuhu(Anhui Province), Guangdong, Chengdu and Shanghai. The third part is going to tell how to construct the use right circulation system of collective construction of farmer rights and interests protection comprehensive land. First of all, make a reforming plan(controlled by the country) for the current system and implement it according to local conditions. Then analyse the details of reformed of the transfer of the system, including subjects, scope,conditions,due time,ways,procedure,price setting mechanism and income dispensation system. Finally, narrate necessary matched measures for the transfer of the right of use of the collective construction land.
