Island In International Law In The Maritimede Limitation

Three quarters of the earth’s surface is covered by the sea, many of the source which we need are contained among them, along with the progress of human science and technology, technical support, people try to develop resources in the ocean, but there is an interest conflict will also subsequently and produce, two wates of the coastal state which are adjacent or have the same maritime space, what or haw to develop these resorce of the maritime space, which relate to two or more countries. So we need a standard law. The United Nations convention on the law came into force in1982. But reality is more complicate than the theory, that’s the key of the maritime delimitation, because of the political or economic make the two countries to negotiate.This article first related concepts of the island, analysis elaborated the islands in maritime delimitation’s effect.according to the position of the island, the island gained by the corresponding effect in action is not the same, it also affects the interests gained by the countries in the delimitation of the sea. In this paper, through the method of theory combining with the actual, based on the United Nations convention on the law combined with the specific case, analyzes the concept and scope of China’s islands in the delimitation of the sea, because of its concept and scope of the different decision effectiveness is also different, produced by the different islands will affect a country’s maritime rights and interests, including a country’s exclusive economic zone waters, territorial sea, continental shelf, contiguous zone, etc. through the concrete analysis and related basic theory of induction and summary island rather than in the United Nations convention on the law of effect problem.China as an ocean country who’s maritime delimitation is more than the others.but because of the history the diaoyu island and China south sea which is China’s island, these islands have island maritime delimitation with some countries.The purpose of this article is try to analisis island and maritime delimitation, in case to solve China’s island maritime delimitation problem, make our ocean law be better, ensure China’s maritime rights.
