Research On The Legal System About China’s Rural Drinking Water Safety

We are a severe water shortage country,the drinking water accounts for only onetwentieth of the world,and the amount of drinking water per capita is only one quarterof the world average per capita,the serious pollution of industrial development, andthe irrational use of resources, exacerbated the drinking water problem. Although thelegal system on the safety of drinking water in our country initially formed system,but the legislative focus on the urban and industrial water, and the legal system of safedrinking water in rural areas is still scarce.in China the rural population is in themajority, in the end of2009there were still270million rural population does notsolve the safety of drinking water, basic water quality and quantity is far from thestandards, impact on people’s health and production activities, grim status quo forcesus should improve the legal system about rural drinking water security.Safe drinking water in rural areas mainly related to water quality, quantity,convenience and guaranteed rate, the ideas of this research is closely around the fourfactors that affect the safety of drinking water in rural areas, analysis of theshortcomings of the legal system of rural drinking water safety, explore how toimprove a specific legal framework for China’s rural drinking water safety. The firstpart of the article defines the concept of safe drinking water in rural areas, overviewdescribes the grim status quo of China’s rural drinking water, in this context introducethe purpose and significance of the research. The second part find out the legislationand legal system defects through analysis the rural drinking water safety laws andconservation status, defects of the legislation is deviation in the legislative concepts,relevant laws and regulations are incomplete, lack of specialized drinking water safetylegislation; Drinking water safety liability system is not perfect, drinking waterpollution emergency response system is imperfect, drinking water source protectionsystem is imperfect, the price of water market regulation system is imperfect. Thethird section describes the legal status abroad about the safety of drinking water inrural areas, reference to the United States, Israel, Germany, comparative analysis toidentify the revelation of the legal system of China’s rural drinking water safety. Thefourth part, combined with the revelation of the foreign legal system, based onnational conditions, clear and correct legislative concepts and legislative principles,improve the safety of drinking water in rural areas in China based on the principle oflegislative system. Research data, to improve China ’s rural drinking water pollution prevention and control system, rural drinking water regulatory system, waterconservation system, to protect the safety of drinking water in rural areas, andpromote the building of new countryside.
