As one of Marx’s early important works,“Economic and Philosophical Manuscripts of1844” has been the focus of academic study, and the theory of estranged labor is the center ofattention. Interpret ion on Marx’s theory of estranged labor are mostly from the angle ofhuman science, economics, political science and so on, excellent achievement about them aretoo many to count, these studies have undoubtedly brought the theory of estranged labor offresh blood and vigor.The purpose of this article is from the angle of social justice to interpret Marx’s“Economic and Philosophical Manuscripts of1844” and discuss Marx’s legal philosophycriticism of which estranged labor is the core. This paper holds that Marx’s theory ofestranged labor contains a profound thinking about critique of legal philosophy. It is from thesocial justice angle, the theory of estranged labor is a philosophical understanding of humanexistence and a kind of ultimate solicitude about the ideal future of entire human society.The article consists of six parts: the introduction mainly describes the research situation athome and abroad, as well as the practical significance of the research. The first chapter,combing the history track of the development of the idea of alienation. It is pointed out thatMarx fundamentally revealed the essence of estranged labor and accomplished a historicaltranscendence. At the same time, Marx’ theory of estranged labor is based on the reality of thebottom to consider human’ supreme idealism, this is beyond any previous thinker.The second chapter analyzes the historical foundation of Marx’s legal philosophycriticism of which estranged labor is the core and mainly focus on Marx’s legal philosophycriticism’s specific embodiment in four basic provisions of the theory of estranged labor. Thethird chapter, analyses Marx’s legal philosophy criticism on the theory of estranged labor,mainly from the aspects of the social fairness and justice evaluation method, measures andfeatures, and the relationship between the estranged labor and social fairness and justice. Thefourth chapter explores the innovation of Marx’s legal philosophy criticism of whichestranged labor is the core.The fifth chapter, answers how to transcend estrangement andpromote social fairness and justice in reality.
