In recent years, the controversial cases such as the "hide and seek" event,"hangzhouracing case","LuoCaiXia case","DengYu jiao case" and so on has attracted the socialattention, and constantly impulse the social public moral intuition, but also puts forward manyquestions for the law. This paper takes the pick up gold case of Liangli as an example,analyzing the case from different charges, expounding the related problems, and proposedsomeT ohwisn a vrtiiecwles.mainly expands from the following three parts:The first part, mainly introduced the basic details of the case, the different opinions ofthe case qualitative, the process and the result of the judiciary trial, including the differentviews of the other lawyers; What kind of accusation has LiangLi’s behavior led to; theobstacles that the judiciary had come across during the process of the trial and the finalresults.The second part, based on the case, analyzes and discusses the related problems of thecase from the criminal law theory. Focusing on the analysis of the three factors, including thepurpose of illegal possession, secret theft behavior and theft object; In the embezzlement,focusing on the analysis of the purpose of illegal possession, the behavior of refusing to returnthe stuff and the occupy object; In the official embezzlement mainly focusing on the analysisof taking advantage of her position and the property of the company these two factors. At last,analyzing the innocence of Liangli from criminal nature.The third part, through the LiangLi case enlightenment that in view of the influence andeffort of the internet in the trial of the case, puts forward the advise that separating thenetwork media from the judiciary but as the same time combine them together in the propertime.
