On Legalization Of China’s Media Supervision And Judicial Justice Relationship Construction

As the constant development of the market economy and the greatinfluence brought by the information age，the media increasingly goes into all areas ofpeople’s lives and has influenced the people from all walks of life. The freedom of themedia comes from the right to freedom of expression and the principle of open trialruled by constitution. The media industry springs up fast and the method of expressingopinions becomes diverse，which offer a wide way for people expressing their opinionsand getting to know the hot issue at the first time. Besides,the media’s supervision tothe judicial process has a positive effect，which will prevent judicial corruption，eliminate the evilness and encourage the goodness， realize the judicial justiceeffectively. Undoubtedly，the judicial sentence must insist in being objective andpresent the truth，solve the issues according to the law and purse the judicial justice. Inthe point of view, media supervision and judicial justice have the same value goal，namely equality and justice. However, during the judicial process，media sometimesdoes not report the case objectively and exaggerate the condition freely in order toattract people’s attention and improve its attention rate, even the media will influencethe judicial consequence to some extent，which has a great negative effect on judicialjustice. There’s no doubt that the phenomenon is against the judicial independence andhas a conflict with the modern idea of rule of law. If there are no measures to solve theproblem, then the trend of “trial by mass media” cannot be reversed. Therefore, theresearch on the relationship between media and judicial justice and the reasonablemeasures on it is of great significance. This essay mainly includes three parts: researchon the meaning and relationship among media，media supervision and judicial justice；summarize the legislation on the relationship between media and judicial justice inAmerica，England，Canada，Germany and France，and then sort out the points，whichcan be absorbed by our country；finally，offer the author’s opinions and suggestions onthe legal construction of dealing with the problem between media supervision andjudicial justice.
