The development is the inevitable trend of social progress, but thedevelopment is also a negative impact on the environment to human survival, and thusharm to human beings living space. Environmental rights of citizens has become a basichuman right, it is not only related to the quality of life of the citizens reality, related tothe reproduction of the human society, children and grandchildren. We need citizens’environmental rights into the constitution, departments wears to strengthen lawenforcement and other ways to be protected.First, this paper investigates citizens’ environmental rights theory. Comb thehistorical path of development of citizens ’environmental rights and theoretical analysisto analyze the types of mature citizens’ environmental rights doctrine, the author from ahuman rights point of view to analyze the environmental rights of citizens believe thatthe rights of the citizen environmental rights is not just local, but basic universal humanrights. Citizens’ Environmental Right theoretical basis is that the environment is suitablefor the survival of the existing inherent natural moral norms, is the logical result of theright to life and the right to health.Second, comparative analysis perspective, the protection of the citizensenvironmental rights at home and abroad. Of the international community for theprotection of citizens ’environmental rights is the study of the first-level perspective, theResearch and Analysis on the protection of citizens’ environmental rights in the UnitedStates and Japan and other developed countries is a second level research perspective,and for the Philippines, South Korea, Sri Lanka and other countries citizens’environmental rights constitute the third level.
