The Investigation On Administrative Guidance Practices In Hunan Provincial Administration For Industry And Commerce

With the trend of administrative democracy, administrative guidance is both anadministrative management style presenting the policies of "putting people’s interestsfirst" and "administrative service" in the modern era, and also a newly administrativebehavior with weak theoretical basis, low level of rule of law and many practicalproblems. At present, the newly administrative guidance has been universally appliedin the administrative agencies in various regions, departments and levels withdifferent implementation paces and degrees. Moreover, it has been widely recognizedin practices. However, to achieve its broad prospect, we have to direct it into the orbitof legalization and standardization.As the law enforcement department of a province in central China, in recentyears, the Industrial and Commercial Administration System in Hunan Province hasarranged administrative guidance in an all-round manner, which is typical in thepromotion of administrative guidance nationwide. To fully analyze the administrativeguidance practices in Hunan Industrial and Commercial Administrative agencies, thisthesis applies the research methods of questionnaire investigation, data studies,interview, and panel discussion survey. The process is: first, conduct a questionnaireinvestigation among the industrial and commercial administrative personnel, rangingfrom provincial level to municipal level, county level and local levels, from variousbusiness lines, ages and position levels; second, analyze the status-quo, effectiveness,problems and causes in the administrative guidance work in the Industrial andCommercial Administrative Agencies in Hunan Province based on the concretestatistics obtained from the questionnaire. According to the investigation, themanagement service targets which the industrial and commercial personnel in HunanProvince engaged with universally accept and call for administrative guidance fromrelevant agencies. Administrative guidance has penetrated into most industrial andcommercial business in Hunan, achieving remarkable results in improving theadministrative effectiveness, alleviating law-enforcing problems, and benefiting thepeople. However, there are still some problems in the administrative guidance,among which the most frequently reflected are "insufficient quality of the industrialand commercial cadres","no standards and operating procedures" for guidance,"lacking of relative incentives", and "too extensive involvement ". The causes are complex, among which the major subjective reason lies in "the accustomed thinkingof valuing punishment yet undervaluing guidance", and the major objective reason is"lacking of incentive mechanism". In the last part, through comprehensive analysisand comparative study, incorporating the reality of the industrial and commercialadministration work in Hunan Province, the author puts forward the followingcountermeasures and suggestions, including: properly recognize the significance andvalue of administrative guidance, advance the guidance work step by step yet withpriorities, rightly capture the key elements in administrative guidance, push forwardthe legalization of administrative guidance, and improve the quality of thecommercial and industrial administrative personnel.
