Selection Of The Trial Model Of The Disputes Over The Contractual Operation Right Of Rural Land

The contractual operation right of rural land is a unique land economic system in China,which is conducive to the stability and development of the rural economy. However, the lawguarantee for the solution to the disputes over the contractual operation right of rural landseverely lags behind, which seriously prevents the development of the rural economy. In viewof this, how to protect the contractual relationship of rural land by the judicial channel in thecurrent legal framework is especially important. This paper endeavors to clear the relevantconcepts of the contractual operation right of rural land and by three cases analyzes that thecurrent judicial trial model in China is unable to fundamentally solve the disputes over thecontractual operation right of rural land, on the contrary makes it become the underlyingreasons for the circular actions and finally proposes the thoughts on the reconstruction of thetrial model of the disputes over the contractual operation right of rural land in China, hopingto have the disputes over the contractual operation right of rural land solved substantially.
