Research On Equal Pay For Equal Work Of Labor Dispatching System In Our Country

The issue of equal pay for equal work in our country has been concerned bydomestic labor law experts. With the implementation of the "Labor Contract Law" in2008, the right of equal pay for equal work has been further confirmed. As a newemployment, dispatch system has become very popular among the different industries,and the reason is that the dispatch system has flexible forms of employment that canreduce labor costs. But with the dispatch industry continues to heat up, some problemsare obviously exposed. On December28,2012, the Thirtieth Session of the EleventhNational People’s Congress Standing Committee adopted to amend “The Labor Lawof the People’s Republic of China”. These amendments are aimed at modifying thedispatch system and the equal pay for equal work, although the modified consequenceremains to be verified. Unequal pay for equal work damaged the legitimate rights andinterests of the dispatched workers, with the process of the implementation, the law ismore like principle statement and lacks actual practicability.It will analyse the specificity of equal pay for equal work under the dispatchsystem on the basis of general understanding of equal pay for equal work. This papercombined the existent forms and present situation with the causes, and put forward torefine the content in accordance with the law, as well as to take measures to play arole of trade unions. Through the analysis of this paper and put forward thecorresponding countermeasures and suggestions, it will help to provide somethinguseful for the perfection and development of the China’s equal pay for equal work ofdispatching system.
