Liang qichao is not only a modern famous political scientists, but also aconstitutional authority theoretician in our country. He is the person who attains thegreatest achievements on constitutional ideas, and his constitutional theory is researchedby many later scholars. In this paper the main content of Liang qichao’s constitutionalideas is summed up: the establishment of constitutional government in creating thenational basic law-the constitution as the premise, with develop "innovating people" asthe basis, the establishment of the state government to realize the path to form two courtsystem congress and the two-party system for the construction of the party’s cabinetmodel. The four aspects of Liang qichao’s constitutional ideas constitute a completetheoretical system.Based on the combing Liang qichao’s constitutional ideas and the brief comments, theheart is sumed up-the national socialist constitutional view. Under the influence of thenational socialist constitutional view, he claims that sovereignty belongs to the state, thefreedom of the country is preferred to the individual freedom, and fostering “innovatingpeople", building a strong government, to establish constitutional government, to realizethe country’s richness and powerful. In his concept, the interests of the state has alwaysbeen to the fore. The country’s richness and powerful is always the ultimate goal ofbuilding a constitutional country. Therefore, his constitutional ideas deviate the primaryvalue unavoidably, with the tools of the theory of colour.Even so, nobody could achieve the depth and breadth of Liang qichao’s constitutionalideas at that time. Even in more than one hundred years later, the constitutional ideas stillhas his merits and can reference to building the socialist constitutional country today.
