The Study On The Legal Regulation Of Universal Postal Service

Abstract:Based on the theory of regulation and law, combined with the advanced experience of universal postal service in and out of our country, this paper analyses the current situation and existing problems in the universal postal service laying emphasis on discussing the compensation mechanism, operation mode, supervision system for universal postal service; infringement act of universal postal service; and its legal responsibility. Now that exclusivity could not be cancelled, it has to be protected by perfecting the legislation and strengthening the administrative law enforcement; bringing in public interest economic litigation to broaden the range of supervision for universal postal service and enhancing the justiciability of the post law; putting forward the new concept of infringement act of universal postal service so that the public would improve their right-protection awareness confronting with infringement act during the progress of universal postal service. At last but most important, this paper works on the market entry for non-public enterprises and independent cost keeping of universal postal service, the operation system of universal service funds, put forward the concept of infringement act of universal postal service and its legal responsibility to build a regulating system for universal postal service.
