The Study On The Legal Protection To Our Rural Land Circulation

In recent years, with the advancement of our industrialization, urbanization andagricultural modernization, rural labor force to cities, land as the important factor needs toreconfigure through circulation. Rural land circulation is the inevitable requirement ofproduction relations adapting to the productivity development and it is the only way todevelop the modern agriculture, and it is also the inevitable choice of rural labor rationaltransfer and promoting farmers into a well-off life. Now, although the country has carriedthe rural land circulation on the related regulations gradually in laws and policies, the lawof the rural land circulation in our country, there is no special specification, and the freecirculation of land has always been constrained by strict conditions. The lack of law andthe conservation of legal practice, have restricted the circulation of rural land severely. Tosolve the low land utilization rate, it needs to relieve the contradiction of population andland, realize the agricultural scale management and establish the normative legal system ofrural land circulation.The thesis is divided into five parts. The first part, as the introduction, mainlydiscusses the selected topic background, research significance, research status at home andabroad, research ideas and research methods, innovation points and difficult points as wellas the theory basis in detail. The second part is the summary of rural land circulation andthe current law system in China, and the connotation of rural land circulation in China, thenecessity of circulation, the relevant legal system, and the land circulation evolutionprocess are introduced. The third part discusses the problems existing in the rural landcirculation in our country, including the low standard of the research analysis to thecurrent land circulation behavior, the low sound of the circulation market development,the immature of the circulation of platform and the farmers’ worry for the land circulation.The fourth part discusses the problems existing in the current law of our country’ ruralland circulation, mainly including the rural land circulation intermediary serviceorganization, dispute settlement mechanism, the contribution of the right to operate thecontracted land problems such as lack of legal provision, indistinct definition of landproperty rights, the deficiency in the system of land contracted management main bodyand the rural social security system is not sound, individual local governments carelessfarmers’ will, forced circulation of land, and many other aspects. The fifth part accordingto the fourth part putting forward the problem, combined with the existing legal system,put forward the corresponding solution countermeasures. Norms socialization service system, establishing multiple dispute resolution mechanism, clear allowing farmers toinvest their land fold into the club, etc., and regulate the circulation of land contract, toperfect the contracted management of certificates and registration system, improve therural land circulation mode, perfect the relevant supporting measures, to promote therational and orderly flow of rural land in our country, realize the land scale management,and develop the modern agriculture.
