Causes For And Countermeasures Property Service Charges Judicial Disputes

With the rapid development of property management services industry,contradictions and disputes between the owners and property service companies will alsorise. Due to the bad service of the property service enterprises, the owners refused to payfor the services. So, there are a lot of contradictions and disputes between the owners andproperty service enterprises. With the enhancement of people’s awareness of the law, moreand more property service charge were disputed to the court, taking up a lot of judicialresources. Property service disputes not only seriously do harm to the interests of theowners and property service enterprise, but also to some extent destroy social stability.The study on how to reduce the amount of the disputes and how to settle such disputes, isgood to save judicial resources, and improve the quality of life of the owners. It is veryimportant to the healthy development of the property services industry and the theharmony of the society.In this paper, with the method of mathematical statistics and quantitative analysis, thewriter investigated the records of People’s Court of Yantai, trying to objectively analyzeand grasp the actual condition of the property service disputes, and then summed up thecharacteristics of the disputes and the multiple reason of the disputes. According torelevant provisions of the management fee of the developed countries, the writer putforward several suggestions, to improve the relevant system of our country. The purpose isnot only to reduce the number of such disputes, but also is favorable of the administrationof justice. The study is helpful to protecting the legitimate rights and interests of theowners, but also promoting the healthy development of the property services industry. Thesuggestions including: increaseing the coordination of legislation; realty service contracttyped; the reasonable intervention of executive power; push forward the small lawsuitsystem, and so on.
