Since then, the first Chinese farmers’ cooperatives have a legal status, can be used as one of the market players and other types of economic entities in the market transactions and economic activity. Its emergence and development is another system innovation after China’s rural reform, which is basis of household contract responsibility system.It can not only greatly mobilized the farmers’ enthusiasm for production, increase the degree of organization of farmers and agricultural production and improve the competitiveness of products in the market to protect the rights and interests of farmers; But also it can promote the industrialization of agriculture and large-scale, optimize the allocation of agricultural resources to promote industrial restructuring and reform of state agriculture. Which is helpful for farmers to provide more employment opportunities and a steady income, which is easy to resolve the "three rural issues" and to promote the harmonious development of society. Therefore, understanding the background of the development of farmer cooperatives, legal characteristics and development constraints,which has important significance for promoting the healthy development of farmer cooperatives in Xinjiang.Starting from the theoretical basis and research data for the development of farmer cooperatives, Firstly, analysis the law of the "People’s Republic of farmers’ professional cooperatives (hereinafter referred to as" Farmer Cooperatives Act"), including progresses and inadequacies),Then analysis the situation and problems of professional farmers cooperatives in Xinjiang, and raised some legal advice to promote the better and faster development of farmer cooperatives in Xinjiang.This paper is divided into five parts:The first part is the basic theory of the Xinjiang farmer cooperatives to introduced the background and significance of this study, the paper argues that understand the background and significance of the development of farmer cooperatives is critical.The second part, including the state and Xinjiang municipality respectively legislation to develop specialized farmer cooperatives in Xinjiang and initiative with analysis of farmer cooperatives progress and insufficient,what’s more,cope with legislative proposals to perfect legislation.The third part, from the research questionnaire to know farmer cooperatives development status of the Xinjiang region, The questionnaire and data mainly from the co-presidents and members of cooperatives in different regions of Xinjiang,In the fourth part, pointed out that the problems of the Xinjiang regional farmer cooperatives. Because the development of the cooperatives themselves is not an ideal situation which need to further improve the environment of the external development of cooperatives.In the fifth part, to aim at the problems in the fourth part of the Xinjiang regional farmer cooperatives, put farword to some legislation and policy proposals, mainly from taxes, financing, supervision, legislation and so on.
