The Research On The Improvement Of Chinese Attorney's Professional Liability Insurance

Attorney's Professional Liability Insurance is an important part of the liability insurance market in China.In recent years,with the rapid development of the economy,the attorney industry is facing a huge challenge of practicing risks while actively developing.At present,China's attorney's professional liability insurance system adopts the unified insurance of the provincial and municipal bar associations,and the provinces and cities apply for the model of different property insurance companies.In the absence of mandatory French promulgation,lawyers' professional liability insurance operates in a form of coercion rather than compulsory.The problems of the insured subject,the insurance liability is too small,and the operating mechanism exposed by the company have been discussed by the domestic academic circles and the industry.With the introduction of the doctor's personal liability insurance in Shenzhen in March 2018,the doctor's professional liability insurance was further enriched,and the improvement of the lawyer's professional liability insurance should also be put on the agenda.This paper analyzes the related literatures at home and abroad,and takes the attorney's professional liability insurance system,insurance liability scope and attorney's professional liability insurance premium as the research object,and studies how to improve the attorney's professional liability insurance in China.The specific research contents are as follows:Firstly,it analyzes the status quo of the attorney's professional liability insurance system,and sorts out and analyzes the insurance coverage of the insurance.It finds that the insurance coverage should include the loss of third party and mental loss.Based on the available data,this paper selects the data of attorney's professional liability insurance from 2001 to 2015,and calculates the attorney's professional liability insurance's premium in 2015 by about 58.7 yuan/person through the gray prediction model and the maximum likelihood estimation method.Finally,based on the above evaluation and empirical results,the system,insurance coverage,premiums and other recommendations are proposed to promote the healthy development of China's lawyers' professional liability insurance.
