The Korea Government Procurement System And The Inspiration To China

The integration of global economy and liberalization of international trade arethe trend nowadays. In this trend, the government procurement market is to openinevitably. China’s accession to the GPA designed to promote governmentprocurement liberalization and market-oriented is also inevitable, which is also aconcrete measure of the overall strategy of China’s reform and opening. The GPAaccession negotiation relates the scope of market liberalization and adjusting thedomestic law. How perfect Chinese government procurement laws and regulations?How to join the GPA at the lowest cost in order to achieve the maximization ofnational interests? These are the issues for China. South Korea’s governmentprocurement system developed earlier. South Korea has already a set of governmentprocurement legal system relatively independent and complete, which base on the"Government Contract Law" and convergence with the GPA. Therefore, It has anextremely important practical significance to learn from South Korea.In this paper, I have sorted out both Chinese and South Korea governmentprocurement law text, the WTO official documents and so on. In addition, I havestudied a large amount of recent research, including the basic theory knowledge, therelevant rules and regulations of GPA, and the analysis on south Korean governmentprocurement system, etc. The first chapter describes the legal system of governmentprocurement system, management system and operation mode, and briefly introducesthe south Korean government procurement dispute processing mechanism. Thesecond chapter introduces the development course and the experience of South Koreato join the GPA. The third chapter discusses the methods of perfecting Chinesegovernment procurement system, and how to use the experience of South Koreaproviding reference for China to join the GPA. On this basis, through the study ofSouth Korea’s government procurement system and its efforts to join the GPA, it’shelpful for China to achieve the maximum national interests, and promote thesustainable development of Chinese economy.
