Study On Legal Guarantee Of Low-carbon Urban Construction

The pattern of low carbon emissions, low energy consumption of resources andlow-pollution urban development is prompted by countries in the face of globalecological problems, a severe form of environmental problems and harmoniousdevelopment issues of human being and society. Developing of low-carbon economyand building a low carbon city has received increasing national attention. WithChina’s rapid economic development, carbon emissions continue to increase, whichhas become a major bottleneck restricting China’s economic development by thepressure of public opinion from the Western countries in the international arena.Therefore, developing low-carbon economy and building a low carbon city becomesthe ultimate way to solve the climate problem and the economic and socialdevelopment contradictions all around the world, including China, which is also thecenter of gravity of China’s sustainable development strategy and the inevitablechoice to take a new road to industrialization.The status quo of China’s urban construction is a high pollution, high energyconsumption and environmental resource law and policy with many disadvantages inbuilding a low carbon city, such as the imperfection of national legal system, the lackof local laws and legal supervision system, and obstacles of policy integration.Practice of the low-carbon urban construction and its’ law in China is still inexploratory stage; market regulation is prone to be a failure easily under governmentregulation. And it is necessary to strengthen the legal protection and inhibit the failureof market and government regulation, having negative effects on the construction of alow carbon city. Construction of low-carbon cities is a long, gradual process, needingto work closely with China’s national conditions and stage of development, taking intoaccount the national long-term and practical interests, taking into account nationalstrategies and their own advantages, taking into account energy conservation anddevelopment to promote each other through continuous exploration and practice in aplanned systematic implementation.This paper reviews the theoretical point of view at home and abroad on the construction of low-carbon city, discussing developed countries in detail by building alow carbon city policies and laws to promote technological innovation to improve thelegal framework to strengthen the system construction, and use of market mechanisms.By a comparative study of building a low carbon city’s at home and abroad based onthe summary of the foreign legal and policy research in building a low carbon city,this paper analyzes reasons led to China’s laws and policies disadvantages in theconstruction of a low carbon city, as well as challenges and opportunities in China,proposing legal protection system of low-carbon urban construction in China, andstriving to propel China’s low carbon urban construction toward better and fasterdevelopment.
